Business Litigation
Whether you are a global corporation or an entrepreneur, your business is your livelihood. The Diulio Firm handles all types of business disputes, ranging from real estate litigation to contract disputes, trade secrets, and investor/board of directors litigation.
Contract Disputes
A contract is a promise yet sometimes promises are broken. Maybe that promise is excused or maybe it caused you significant damage. We have handled and litigated multi-million-dollar contract disputes, and obtained millions of dollars for our clients.
Real Estate Disputes
Real estate is the sun in which California revolves. Given real estate’s importance and often high cost, this can lead to disputes. We have represented real estate developers, partnership, joint venturers, lenders, and landowners in all aspects of real estate litigation.
Investor / Partnership / Ownership Disputes
Many businesses have investors or multiple owners. When things don’t go as planned, disputes may arise. We have extensive experience representing investors/equity owners in small and medium sized businesses, including in derivative actions for breach of fiduciary duties. We have also counseled and represented partners or co-owners in “business divorce” matters where the partners or owners no longer see eye-to-eye. If you have this type of dispute, you can trust the advocacy of The Diulio Team, which has secured millions of dollars for clients in investor or ownership disputes.
Trade Secrets
The law protects legitimate trade secrets from misappropriation, as long as appropriate steps were taken. This is an area where disputes arise between businesses, as well as between businesses and former employees. We can provide counseling to mitigate these risks or represent you if a dispute has already arisen.
Qui Tam / False Claims Act
A qui tam action is a civil enforcement suit brought by a private whistleblower (the “relator”) on behalf of the government to recover treble damages, civil penalties, and other relief for fraud or false claims submitted to the government. At the federal level, these actions proceed under the federal False Claims Act (FCA). In California, analogous actions proceed under the California False Claims Act (CFCA), Cal. Gov’t Code §§ 12650–12656. We have extensive experience with these claims and can help navigate the numerous procedural and practical hurdles they present.
